PSA annuls decision relating to living quarters at Alvheim

In a letter to Marathon Petroleum Norge AS (Marathon) dated 21 April 2008, the Petroleum Safety Authority Norway granted an exemption from Section 59 of the Facilities Regulations relating to living quarters in the period until 31 March 2009. Following an appeal from the safety delegate service and Mærsk Ansattes Forening (Mærsk employees' association), we have annulled the decision.


Marathon's updated application for consent to use the Alvheim facility included an application for acceptance for increased use of shared sleeping quarters than is considered normal in the period until 31 March 2009. On 21 April 2008, we granted an exemption from Section 59 of the Facilities Regulations to allow the billeting of more persons than the living quarter's capacity is designed for. The exemption was granted under the assumption that the employees are certain to get necessary rest and recovery.   

The safety delegate service in - Maersk Contractor Norge AS and  Maersk Ansattes Forening appealed our decision in a letter dated 29 April 2008.

As a result of information which emerged during our processing of the appeal, we have decided to annul our decision, cf. Section 33, second subsection of the Public Administration Act. Our overall assessment of the information presented is that  necessary rest and recovery will not be assured for all employees in the period in question.
